TERMS OF USE

winebay.shop is an online and physical store primarily selling alcoholic beverages. The seller is Loodus Fest OÜ (registration code 12905060) (hereinafter referred to as winebay.shop). The Terms of Use form the basis for concluding commercial transactions between winebay.shop and its customers (hereinafter referred to as the customer or customers).

winebay.shop sells goods to both individuals and business customers purchasing goods for commercial purposes. Loodus Fest OÜ is a company engaged in both wholesale and retail trade. Issues not covered by the sales contracts and other written agreements between winebay.shop and business customers are regulated by the laws of the Republic of Estonia and the European Union.

The sales contract between winebay.shop and the customer comes into effect at the moment the order is placed on the website www.winebay.shop. Liability for defective deliveries or departmental or foreign trade restrictions is limited to canceling the order and refunding the payment. winebay.shop sells goods only to those of legal drinking age. By making a purchase on the winebay.shop website, you confirm that you are at least 18 years old. When making a purchase, you also confirm that you are the holder of the credit card or bank account used for payment on the winebay.shop online store. The customer's age will also be verified upon delivery. winebay.shop may refuse to deliver the goods if you cannot confirm your age upon receipt. In this case, the purchase price and shipping fees will not be refunded. When receiving the goods from a parcel terminal, you will need to verify your identity using your ID card.

winebay.shop reserves the right to limit the sale of goods when unusually large quantities are ordered. If the customer orders goods that are manufactured, ordered, or specially processed based on their order, any additional costs that may arise due to order cancellation must be fully reimbursed by the customer. winebay.shop reserves the right to unilaterally change the Terms of Use without prior notice. The Terms of Use applicable at the time of order placement shall apply to the order. For subsequent orders, the version of the Terms of Use valid at the time the order is placed shall apply. Amendments to laws take effect immediately unless otherwise stated in the law.

These Terms of Use apply to the extent that they do not limit consumer rights as provided by consumer protection laws.

DELIVERY OF GOODS

winebay.shop delivers goods only within Tallinn.

We only offer delivery within Tallinn. All orders are delivered by courier within 3 working days from the moment of order placement. Deliveries are made on Mondays, Wednesdays, and Fridays between 12:00 and 15:00.

When placing an order, you have the option to choose self-pickup. You can pick up your order at Mäealuse 10, Unit C, Gate 3, Tallinn from 10:00 to 18:00 on any working day. To receive the goods, you must present an identification document.

Please note that we do not offer delivery to parcel lockers.

The customer is responsible for providing accurate personal information, address, and contact phone number when placing the order. winebay.shop and the courier company are not responsible for any delays or misunderstandings in the delivery of goods if the delay or misunderstanding is related to inaccuracies or incorrect information provided by the customer when placing the order. If the package was damaged, the time and cause of the damage must be recorded in the presence of a representative from the courier company.

winebay.shop and the courier are responsible for ensuring that the goods are delivered undamaged, in good condition, and correspond to the description on the winebay.shop website. If you receive damaged or broken goods, they will be replaced with new ones or the cost will be refunded. If, upon receiving the goods, you notice that the packaging is damaged or wet, do not accept the package, but make the appropriate statement to the courier and notify us by writing to info@loodusfest.com.

NB! Special requests and other comments (e.g., broken intercom, aggressive dog in the yard, inability to receive goods between 12:00 and 14:00, someone else will receive the goods on your behalf, etc.) can be entered in the information window. You will find the information window when you reach the data entry page during order placement.

RETURN OF GOODS

winebay.shop is responsible for any non-conformity of the goods sold to the customer (according to the legislation of the Republic of Estonia and the European Union, except for perishable food products) with the terms of the contract or for any defects that existed at the time of delivery and are discovered within two years from the delivery of the goods to the customer. In the first six months, it is presumed that the defect existed at the time of delivery. The burden of proof for this presumption lies with winebay.shop.

The customer has the right to contact the online store within two months by sending an email to info@loodusfest.com.

winebay.shop is not responsible for defects that arise after the goods are handed over to the customer. If the goods purchased from winebay.shop are defective and winebay.shop is liable, winebay.shop will repair or replace the goods. If the goods cannot be repaired or replaced, winebay.shop will refund the customer all payments related to the sales contract.

winebay.shop will respond to the consumer's complaint in writing or in a form that allows written reproduction within 15 days.

DISPUTE RESOLUTION

If the customer has any claims regarding winebay.shop, they must be sent to info@loodusfest.com.

If the customer and winebay.shop cannot resolve the dispute by mutual agreement, the customer may contact the Consumer Disputes Committee. The conditions for filing a complaint and submitting a claim can be found here.

The Consumer Disputes Committee is responsible for resolving disputes arising from the contract between the customer and winebay.shop. The examination of complaints at the Committee is free of charge.

The customer can also contact the European Union's Online Dispute Resolution platform.

CANCELLATION OF ORDER

You can cancel your order by contacting us at info@loodusfest.com before we dispatch the goods from the warehouse. If the goods have already been dispatched by courier, the order cannot be canceled.
